Depending on how many people were around him, he could have been charged with multiple counts of negligence, since he endangered more than one person. The gun charge is a one shot (heh) thing. Just checking New York state laws–I can't seem to find the penalty for criminal negligence, because it's involved in so many other charges. But, reckless endangerment with a deadly weapon is a Class D felony. Unlawful possession of a handgun is a Class C felony (one step more serious).
