Senator Biden, Meet the U.S. Constitution.
Joe Biden, running for the Democratic nomination for President,put the President on notice last week. If the President bombs Iran, Joe Biden is gonna get him!
But let me tell you, I have written an extensive legal memorandum with the help of a group of legal scholars who are sort of a stable of people, the best-known constitutional scholars in America, because for 17 years I was chairman of the Judiciary Committee.
“I asked them to put together [for] me a draft, which I’m now literally riding between towns editing, that I want to make clear and submit to the Untied States Senate pointing out the president has no authority to unilaterally attack Iran. And I want to make it clear, I want it on the record, and I want to make it clear, if he does, as chairman of the foreign relations committee and former chair of the judiciary committee, I will move to impeach him.”
Uh….no. No, he won’t. And here’s why. Joe Biden, as a U.S. Senator has no power to “move to impeach” the President. That power lies solely with the House of Representatives per Article I, Section 2, Clause 5 of the Constitution of the United States. Biden’s only power as a U.S. Senator is to be part of the body that tries the impeachment. That’s it.
One would thought that his impressive array of Constitutional scholars and his 17 years in the Senate Judiciary committee would have helped here. Maybe, instead of grandstanding for the anti-war fanatics, he should spend a little more time doing his homework.

I also recall something in the Constitution about the president being commander in chief of the armed forces.
If a president failed to move in response to an imminent threat, then he'd have commited an offense worthy of impeachment, not the other way around.
